Terms of Service

1. Scope

These Terms of Service govern your use of the Fluxer service (hereinafter "Service"), operated by Jan Herklotz, Birkenstr. 23, 65187 Wiesbaden, Germany (hereinafter "Operator"). By using the Service, you agree to these terms.

2. Service Description

Fluxer allows uploading and sharing video files via time-limited, publicly accessible links. The Service is free of charge. Uploaded videos are automatically deleted after 30 days. There is no guarantee of availability of the Service.

3. User Obligations

You agree to:

  • Not upload any illegal, violent, pornographic, or otherwise objectionable content.
  • Not upload content that infringes on third-party rights (including copyrights, trademarks, and personality rights).
  • Not use the Service to distribute malware, spam, or other harmful content.
  • Not misuse the Service or impair its functionality.

4. Copyright and Liability

You warrant that you hold the necessary rights to any content you upload. The Operator assumes no liability for user-generated content. Upon becoming aware of rights violations, affected content will be removed immediately (see also DMCA).

5. Limitation of Liability

The Operator is liable without limitation only for damages arising from injury to life, body, or health, and for damages caused intentionally or through gross negligence. All other liability is excluded. The Service is provided "as is" without any warranty. In particular, there is no guarantee that uploaded files will remain available for the full 30-day period.

6. Deletion and Blocking

The Operator reserves the right to delete uploaded content or block access without prior notice, particularly in cases of violations of these Terms or suspected illegal content.

7. Changes

The Operator reserves the right to modify these Terms of Service at any time. The current version is always available on this page. Continued use of the Service after changes constitutes acceptance.

8. Governing Law

German law applies. The place of jurisdiction is Wiesbaden, Germany, to the extent permitted by law.
